Welcome to Amala. These Terms and Conditions govern your use of our website and the purchase of our bespoke floral arrangements, vase creations, and venue styling services. By accessing our website or placing an order with us, you agree to be bound by these terms, which are designed in accordance with the laws of Victoria and the Commonwealth of Australia.
1. General & Business Information
- Business Ownership: This website is owned and operated by Amala and trading as Amala.
- Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria and the federal laws of Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Victoria.
- Service Overview: Amala provides bespoke bouquets, custom vase arrangements, and event floral decorations.
2. Bespoke Floral Products & Substitutions
- Natural Variations: Flowers are natural, living products. While we make every effort to match arrangement descriptions and photos, actual blooms may vary slightly in shade, size, and form.
- Seasonal Availability: All floral designs—including custom orders, native selections, and color-specific palette requests—are subject to seasonal availability.
- Substitutions: If a specific flower or vessel requested is unavailable, Amala reserves the right to substitute it with a similar flower or vessel of equal or greater value, maintaining the overall color palette, quality, and aesthetic of the design.
3. Pricing & Payment Terms
- Currency: All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST), unless explicitly stated otherwise.
- Payment: Full payment is required at the time of placing an order through our secure online payment gateways. Orders will not be processed or scheduled for delivery until payment has been successfully cleared.
- Price Changes: We reserve the right to modify prices for products, delivery fees, or custom services at any time without prior notice.
4. Ordering, Changes, & Cancellations
- Order Confirmation: Once an order is placed, you will receive an automated email confirmation detailing your purchase. Please review this carefully and contact us immediately if any delivery details are incorrect.
- Custom Orders: Custom floral commissions require specific stem sourcing and preparation. Once a custom design order is confirmed and processed, changes to flower types or overall color schemes may not be possible.
- Cancellations:
- Standard Orders: Requests to cancel or reschedule a standard delivery must be made at least48 hours prior to the scheduled delivery date for a full refund or credit.
- Event & Bespoke Commissions: Custom or venue decoration orders require customized sourcing and planning; cancellation terms for these will be specified in your individual service quote.
5. Delivery & Recipient Responsibility
- Delivery Zone: Amala primarily services the Melbourne metropolitan area. Delivery charges are calculated based on destination location at checkout.
- Delivery Information: It is the customer's responsibility to provide accurate recipient contact details and physical delivery addresses (including unit numbers, business names, or gate codes). Amala accepts no liability for delayed or failed deliveries due to incorrect information provided by the customer.
- Unattended Deliveries: If the recipient is not present at the time of delivery, our couriers will leave the flowers in a safe, sheltered place at the property if deemed safe to do so. If no safe location is available (e.g., locked apartment complexes), the arrangement will be returned, and a re-delivery fee may apply.
6. Freshness, Quality, & Refunds
- Australian Consumer Law: Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
- Perishable Goods Policy: Flowers are perishable. To ensure the highest level of service, any quality concerns must be reported to Amala within 24 hoursof delivery, accompanied by photographs showing the condition of the flowers and vase arrangement.
- Remedies: If an arrangement is deemed defective or damaged upon arrival, we will, at our discretion, offer a replacement arrangement, store credit, or refund in accordance with your rights under the ACL.
7. Intellectual Property
- Digital Assets & Imagery: All content on this website—including logo designs, text copy (including founder biographies and service descriptions), edited HD photography, and high-definition hero images—is the exclusive intellectual property of Amala.
- Usage Restrictions: You may not copy, reproduce, modify, or distribute any visual or textual content from this website without explicit, written authorization from Amala.
8. Limitation of Liability
To the extent permitted by Australian law, Amala shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our website, service delays, or improper care of floral arrangements once delivered.
